Artak Davtyan is considered appointed to the post of Chief of the General Staff of the RA Armed Forces by force of law. The Prime Minister of the Republic of Armenia, Nikol Pashinyan, stated this.
“Guided by the Constitution and the relevant provisions of the RA law ‘On Military Service and the Status of a Serviceman,’ on March 10, 2021, the Prime Minister submitted a proposal to the President of the Republic regarding the appointment of Artak Davtyan as Chief of the General Staff of the RA Armed Forces, attaching the corresponding draft decree.
On March 11, 2021, the President of the Republic’s objections regarding the aforementioned draft were received by the Prime Minister’s Office. The objections submitted by the President of the Republic were not accepted by the Prime Minister, of which a written notice was sent to the President of the Republic on the same day, with the corresponding justifications.
Taking into account the fact that within the time limits set by Part 3 of Article 35.1 of the RA law ‘On Military Service and the Status of a Serviceman,’ the President of the Republic did not sign the draft submitted by the Prime Minister and did not apply to the Constitutional Court, guided by Part 3 of Article 139 of the Constitution, as well as Part 6 of Article 35.1 of the RA law ‘On Military Service and the Status of a Serviceman,’ from March 22, 2021, Artak Davtyan is considered appointed to the post of Chief of the General Staff of the RA Armed Forces by force of law,” the statement said.
