The President of the Republic of Armenia, guided by Article 169, Part 1, Point 4 of the Constitution, has submitted an application to the Constitutional Court requesting a determination of the conformity with the Constitution of the law of 15 November 2017 “On Military Service and the Status of the Serviceman.”
As reported by the Department of Public Relations of the RA President’s Office, the submission of the application is also conditioned by problems present in the practical implementation of the said law, which became more evident as a result of the Prime Minister’s initiative to dismiss the Chief of the General Staff of the Armed Forces of the Republic of Armenia, Onik Gasparyan, and the ensuing constitutional legal processes.
Within the scope of the powers vested in it by law, the Constitutional Court has the capacity to conduct a comprehensive and systematically interconnected examination and render a decision.
With the submitted application, the decisions of the Constitutional Court and the possible measures to be taken may have a serious impact on decisions adopted thus far and on current and future processes related to the existing situation, with regard to the interpretation and application of the aforementioned law.
The President of the Republic has expressed the hope that the adoption of an appropriate decision as quickly as possible will bring legal certainty and contribute to the resolution of the current crisis.
